Terms of Service

Plain-language terms for a product still in active development. They set out the deal between you and us fairly, without hiding anything in the fine print. In case of any discrepancy between language versions, the Ukrainian text prevails.

These Terms of Service (the “Terms”) govern your use of the Mes application and the messaging service that supports it (together, “Mes”, the “Service”). By installing or using Mes, you agree to these Terms. If you do not agree, please do not use the Service.

§ 1 These terms & who provides Mes

Mes is provided by the provider of the Mes service, registered in Ukraine (“we”, “us”); the provider's full legal-entity details will be published before public launch and are available on request. These Terms work together with our Privacy Policy and Licence Agreement, which are incorporated by reference.

§ 2 Eligibility

You must be at least 16 years old, and legally able to enter into these Terms, to use Mes. By using the Service you confirm that you meet these requirements and that your use will comply with all laws that apply to you.

§ 3 Your account and your keys

Mes creates cryptographic keys on your device that represent your identity. You alone hold them. This is the source of the Service's privacy, and also your responsibility: if you lose your device and your recovery phrase, we cannot restore your account, your identity or your message history — no one can. Keep your recovery phrase safe, and protect the device and PIN that guard it. You are responsible for activity that takes place through your account on your device.

§ 4 A pre-release service

Mes is offered on a pre-release / beta basis while we complete reliability, group features and an independent security audit. During this period the Service may change, be interrupted, or contain defects; features may be added or removed; and messages may, in rare cases, be delayed or fail to deliver. The Service is provided “as is” and “as available” (see §10). Do not rely on Mes as your sole channel for time-critical or life-safety communication during the beta.

§ 5 Acceptable use

Privacy is not permission to harm others. You agree not to use Mes to:

  • break the law, or facilitate serious crime;
  • create, store or share child sexual abuse material (CSAM), which is absolutely prohibited and abhorrent to us;
  • harass, threaten, defame or incite violence against others;
  • send spam, malware, or unsolicited bulk messages;
  • infringe intellectual-property or privacy rights;
  • attack, probe, overload or attempt to circumvent the security of the Service or its infrastructure; or
  • reverse the privacy protections against another person (for example, to deanonymise or surveil them).

§ 6 Content & moderation in a zero-knowledge system

Because Mes is end-to-end encrypted, we do not and cannot monitor the content of your communications, and we do not pre-screen messages. You are solely responsible for what you send. Where we receive a credible report or are required by law, we may act on the information available to us — for example, by restricting or blocking an account, disabling abusive server functionality, or removing an account from the Service — without access to message content. Tools such as user-side reporting and blocking exist so that recipients can act on material they receive.

§ 7 Running your own server

Mes lets you connect to a server you operate, self-hosted or in a cloud you choose. If you do, you are the operator of that infrastructure: you are responsible for its lawful operation, security, availability and for any personal data it processes, and you act as the controller for that deployment. We provide the software; we do not administer your server and are not responsible for it.

§ 8 Intellectual property

Mes, its software, the “Mes” name and mark, and the site are owned by us and protected by law. Your right to use the application is granted under the Licence Agreement, not transferred. Mes includes third-party open-source components licensed under their own terms; nothing in these Terms limits your rights under those licences.

§ 9 Third-party services

Mes is distributed through the Apple App Store and relies on Apple services (including push notifications) and on the networks you connect through. Your use of those services is subject to their own terms, and we are not responsible for them.

§ 10 Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that the Service will meet your requirements or that defects will be corrected. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including mandatory consumer rights.

§ 11 Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising out of or relating to your use of (or inability to use) the Service. Because Mes is presently provided free of charge and in beta, our total aggregate liability to you is limited to the greater of the amount you paid us for the Service (if any) in the twelve months before the claim, or EUR 100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

§ 12 Indemnification

You agree to indemnify and hold us harmless from claims, damages and reasonable expenses arising out of your unlawful use of the Service or your breach of these Terms, to the extent permitted by applicable law and not caused by us.

§ 13 Suspension & termination

You may stop using Mes and delete your account at any time; deletion removes your server-side records and wipes local data from your device. We may suspend or terminate access if you materially breach these Terms, if required by law, or if necessary to protect the Service or its users — where practical and lawful, with notice.

§ 14 Governing law & disputes

These Terms are governed by the laws of Ukraine, without regard to conflict-of-laws rules, and disputes are subject to the competent courts of Ukraine. If you are a consumer resident in the EU or elsewhere, you keep the benefit of any mandatory protections and the courts available to you under the law of your place of residence. We would always rather resolve a concern directly first — please contact us.

§ 15 Changes to these terms

We may update these Terms as the Service evolves. We will change the effective date above and, for material changes, provide reasonable notice in the app. If you continue to use Mes after an update takes effect, you accept the revised Terms.
